1. Acceptance of Terms
By accessing and using Gemtrack, you agree to be bound by these Terms of Service. If you do not agree, please do not use this service. Gemtrack reserves the right to update these terms at any time. Continued use of the service constitutes acceptance of any changes.
2. Use License
Permission is granted to use Gemtrack for personal, non-commercial purposes only. You may not modify, copy, reverse engineer, or redistribute any part of the application. Automated data collection, scraping, and any use for illegal purposes are strictly prohibited.
3. Disclaimer of Warranties
Gemtrack is provided on an "AS IS" basis without warranties of any kind, expressed or implied. We do not guarantee the accuracy, reliability, or availability of the service or its materials.
4. Limitations of Liability
Gemtrack and its suppliers shall not be liable for any damages arising from the use or inability to use the service, including loss of data, profit, or business interruption, even if notified of the possibility of such damage.
5. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized access. You are solely responsible for the accuracy and legality of all data you store on Gemtrack.
6. Payment Terms & Refund Policy
Gemtrack offers a free plan with limited usage and a paid subscription with expanded features. Paid subscriptions are billed monthly. You may cancel your subscription at any time, and access will continue until the end of your current billing period. No refunds will be issued for partial billing periods. After the billing period ends, your account will revert to the free plan.
7. Cancellation and Termination
You may cancel your subscription at any time through your account settings or by contacting support@gemtrack.lk. Gemtrack reserves the right to terminate or suspend your account at any time if we believe you have violated these Terms or engaged in illegal activity.
8. Intellectual Property
All materials on Gemtrack, including software, design, trademarks, logos, and documentation, are protected by applicable copyright and trademark law. You acknowledge that Gemtrack retains all intellectual property rights in the service.
9. Third-Party Services
Gemtrack may integrate with third-party services for payment processing, cloud storage, and other functionality. Your use of these services is subject to their respective terms and policies. Gemtrack is not responsible for third-party service failures or data loss.
10. Governing Law
These terms are governed by and construed in accordance with the laws of Sri Lanka. You irrevocably submit to the exclusive jurisdiction of the courts located in Sri Lanka.
